Recently I spoke with a lawyer. He said I have a very good chance to get NIW approved(6 abstract, 1 publication, 2 manuscript in preparation,1 presentation in international meeting, 1 patent submitted and I am M.D.). Rightnow I am into clinical research. But probably I will be into residency(Clinical training program) from this July 2004. Now I maintain H1b but unfortunately in residency(Clinical training program) I have to have J1 or at least EAD to start residency, because money comes from MEDICARE. Even my employer will be the same but different job. My employer is ready to provide further help if needed infuture. But I am debating with myself whether I should go for NIW or not. And what are the problems might arise? Also if NIW gets denied, should I loose my status? Will I be readily able to get J1 instantly? Please help me out by your valuable opinions.
