If I apply for NIW EB2 ( I donot need LC, will be directly filling I-140), will this make me eligilbe for 7th years H-1B extension.(provided the I-140 is pending)?
Since there is no LC application needed for NIW application my priority date will be the I-140 application, and certainly it will not be more than 1 year old.
