Hello people

I wanted to lie low for a while but the thread posted by Srivatsa scared the habib out of me!
I had nightmares last night. I didn’t have a computer degree at the time that I applied and got my I-140. I don’t know if this is going to be a new issue.

I don’t have my H1 anymore because I let my Visa stamp expire (past one year). What happens in a situation like srivatsa's? Does one become out-of-status the day we receive such a notice? What course of action does one take?

Srivatsa and sramasub1, please keep us updated on the developments. Are you guys still on H1?

Also are you guys annoyed by almost_free's threads? I am!

No. My H1 expired November 2001 and did not renew it.

Consult Your Lawyer ASAP, remember Defence is the best form of Attack, Be prepared, with all pertaining Documents, if in doubt get a second opinion from another Lawyer.

Like I said on another thread, INS cannot just Deny without giving you an opportunity to prove your case, (RFE,NOID etc).

Worst case scenario, even if they deny, you can file a MTR (Motion to Reopen/Re consider).

Most Important dont forget, every year of work experience that you have adds to your Credibility, and Educational Qualifications.

Also If your H1 stamp is expired, but if you do have a Renewed H1 (Not stamped) I think you can send your Passport to St Louis by mail and they will stamp the Visa and send you back the Passport. (Also ask Lawyer about it).

Dont panic, and dont let it get the better of you, stay calm and think and act Rationally.

I was myself looking for an answer to this (from purely educational reasons) and I agree with Girish. Labor doc. holds the key coz that reflects ur job reqmnts., educational qualifications to meet the same etc.

that this not a new stunt invented to prevent issuing GC's in line with the recent outcry regarding the unemployment increasing and immigrants being the cause for it. Good luck to all, let's wait and see what destiny has in store for us.....
 
Also

SRAMASUB1, did others from your firm get their GC's without this issue, or has there been a past occurance as well?

I don't understand this. Noone except Comp.Sc degree holders gets green card ? Is it ?
Is this a new rule imposed by INS ?
I better contact my previous companies in India whether they will take me in. This is getting so ridiculous.

I do have a computer degree but I didnt have it at that time. dont know if that might help.

Ramasubbu: Did you also have an RFE at the 140 stage?

July16: Octal (31) = 8*3 + 1 = 25 in Decimal system
