Newyork Newyork Rir

converted

So you converted ur case or filed a new case. Do you retain your priority date or the priority date is now Sept 2001.

You should change your attorney and go with James D Mills. Call him up and talk to him there are lot of replies he has put in there.

Does this also contribute to diverse the resources of NY SESA ?

If many NON RIR Appplicants who have been waiting for so many years (Yr. 98, 99, 2000 and before April 2001) are changing their non rir applications to RIR , the workforce at NY SESA would be spending their time ot work on such applications too, as thier priority date would be in those earlier years!!!!
Naturally, thsi would delay the process for the applicants who applied in april and later !!!

Does this add to the more processing time at NY SESA ?

No not like that

For RIR processing, their PD will be the date when they request to
convert it from regular to RIR. And the RIR conversion Regulation
was finalized and issued only in July/August 2001. If you applied
prior to july/august you should be fine.

You can read Regular to RIR conversion Regulation at
http://wdr.doleta.gov/directives/attach/GAL2-02AttachB.pdf

Read the last paragraph.

But they will be retaining the old priority date for I-485/CP processing.

No Title

You are right .. \'Priority Date\' means something only at the 485 stage. For labor, my priority will still be sept 2001 (conv. date)

BTW, does anyone think there is a chance that NY SESA will reach sept. applications before the end of this year (that is when my H1 expires)

No body knows clearly how they are handling the APRIL situation

I talked to a lady at NY SESA. She gave me very vague answer.
This is the summary of my talk with the lady.

1)Currently (as of 02/28/2002) they are processing end of March and
  early April cases.
2) In April they received record breaking no of applications.
3) She didn\'t give me any idea of how much time it will take to
   process APRIL applications.
4) She was also not sure of what is the impact of April cases on RIR
   processing.

I felt like some parrot speaking.

But according to Jim, immigration Attorney, most of the april 245(i)
RIR cases are skeleton applications and the rejection of those kind
of applications will take lot of time as Certifying Officer has to
prepre the explanation for rejection.

Indeed NY SESA SUCKS !!!!!!!!!!!!!!!!!!!!!!!!!!!

Does every one get the reply back from LCSTATUS email system

I tried with my employer phone number but it says no cases are found and gives me syntax to send it. I know my employer has filed many cases. why am i not getting such a reply?

NY SESA backlog

Well i spoke with my lawyer to re file my LC in Florida state to get out of this mess...today he told NY/NJ/VA SESA has almost finished its mess and he think its better to continue in NY . In fact in 140 & 485 stage vermont is really fast so no use in jumping around

so guys lets keep our fingers crossed and hope for the best

well i am not sure its another lawyers gimmicks statement

Were you going to use the same lawyer to file the new labor in FL ?

I fnot, he might be looking to retain his client purely in terms of his business!!!

Otherwise It sounds to be a good news!!!!

I suggest

we try and contact our attorneys to see if sasivm\'s attorney\'s story can be substantiated. I have left a message for my attorney and he generally gets back to me asap.

LCSTATUS02@doleta.gov doesnt exist anymore, they also stopped replying via email or on the phone no 212-337-2184. They ask to contact your lawyer or employer . WHATS GOING ON ? makes me worried ...
