Greetings!

Here is my situation: I am a US born citizen who is married to an Indian-born citizen. The marriage was done in India last week. I want my wife to be with me asap here in US. I have not started applying for a visa yet.

1) If a K1 visa is faster (as I have read), should we apply for that even though we are married? Is it significantly faster?

2) Can she apply for a visitor visa now? If so, will it affect our chances of getting a K3 visa? The idea behind obtaining a visitor visa is so we can be together faster (realizing she would have to go back to India to get the K3)

Thanks!

1) The K1 is the faster visa, though as you are married you are not eligible to apply for it as it is for fiances of US citizens. The visa you are to apply for is either the K3 or the CR1/IR1 spousal visas.

2) She can apply for a visitors visa, and this will not have any effect on an intending spousal visa. However, the spousal visa may prove a hurdle that could possibly result in the denial of a tourist visa as there is clear immigrant intent at some point in the future.
