Hi....I am new to this forum and I am a little confused on how to handle my situation. Let me start by giving some background (sorry if its too long):

I was with my ex for 2 years before we decided to get married (he is from Michocan, MX). We got married in May 2007. We filed his papers and he received his conditional residency in February 2008. Everything was fine for the 1st year of our marriage (of course there were little things that I question now). During the 2nd year I went for surgery to reverse my tubal ligation because he didn't have any kids and he stated he really wanted a baby with his blood. Turns out the surgery was for nothing because he was clasified as beign infertile (after months of trying, I convinced him he needed to get tested). I'm not sure if that is what started putting stress on our marriage or not, but shortly after that he seemed to start changing the way he talked and acted with me and my kids (3 from previous relationships). He didn't treat us like we were part of his family...It was more like we were just there and we were expected to accomodate him in everything he wanted. I finally told him that he either changed or we walk...The change didn't last long, but I waited and hoped for another year until I just couldn't handle it anymore. I finally left him right days before our 3 year anniversary. My divorce was finalized 2/08/11.

Now on to my new situation:

I recently re-married on July 1 2011 to the love of my life who also happens to be my best friend. I first met him about 7 years ago and we had an immediate attraction, but he was in a relationship at that time with his sons mom so we left it as friends. After my 1st marriage broke up I ran into him again...and we started hanging out and then started dating. In July of 2010 I even went to Durango, Mexico by myself and visited his family (I knew his dad already from years before). When I came back we started talking about marriage...But I hadn't filed my divorce yet cause I didn't have the money (I finally filed my divorce on 11/2/10). So off and on for months we talked about marriage, life, family and so on....Then we went out one night at the end of January and we ended up getting pulled over. He was arrested for DWAI, served his time and was granted Voluntary Departure in April 2011. Me and my 2 youngest kids went on vacation to go see him. During our vacation we decided to go ahead and get married :D.

So now I am trying to figure out how I proceed with the process....the I-130 requires you to list the last address where we lived together, which there is none. We also need to submit proof of a Bona Fide marriage.....We don't any have bills, property or kids together (yet!) so exactly what am I suppossed to send them???

Again...I apologize that this was a book....I just didn't really know how to explain with out going into some of the details (beleive me....this in't even the half of it!). Any advise would be greatfully appreciated!
 
An attested marriage certificate and some pictures should do the trick for now till you can come up with the bank statements and bills till the interview date
 
Was this love of your life here illegally[without inspection]? Had he overstayed a visa? If he had for how long?
 
He was here EWI. He has an approved I-130 that his resident father filed for him in October 2001.

This is a pretty complicated case. I would strongly advise you get a lawyer. EWI, DUI, voluntary departure, prior marriage by petitioner. Getting a competent immigration attorney is your first step in preventing this already difficult case from taking on a the description of a compound disaster of epic proportions.

I am single male 26 years old from Jordan my mom get the green card via F3 application and automatically all my family get the green card (my dad and my 2 brothers) except me because I am older than 21 as u know .I have application since NOV/2010 through my mom(she is permanent president) is called I 130 for unmarried son older than 21 (I-797c).My questions are:
1-Do you know when I will get the green card "the processing time" the minimum and the maximum time??
2-Do they study each situation separately because I am the only one from my family outside US waiting to follow them???
 
Thanks for the advise ananga73...Unfortunatly we are unablr to afford a lawyer at this time :( I had a feeling this would be a little complicated, and I know I will be scrutinized during the interview based on my first marriage, but I need him here. There is no way I can move to Mexico....My oldest daughter couldn't even go on vacation with us because her father wouldn't allow me to take her (refused to sign for he passport).

You have a long time to go. At least another four years. See the USCIS website for when your priority date will be current. Every application is typically evaluated in its own light.

4 years for what? I haven't filed my I-130 yet.....Is it 4 years for the one my hubby's dad filed?

Fabio2011...can you please start your own thread. I started this thread for my situation hoping to get some answers and help. With you posting questions regarding your situation in my thread...its confusing me even more.

As a result of being in the US illegally for years and now being outside the US, he will have to wait out the 10-year ban. Unless he can get an I-601 waiver, which will require a good lawyer to have a decent shot at success.

The petition his father filed for him got voided when he married you, unless his father became a US citizen before the marriage to you.
