I guess people who have a PD after this date will not get their 485s approved. So if your labor filing date is after this date and you have filed in EB2 category, then you will not get your 485 approved. New filers will not be able to file 485 until their PD is before this date. However, if you have already filed and have received your receipt notice, you can continue to renwew your EAD / AP and use them.abc_xyz said:-Is it going to affect only new 485 filers or every one whose PD is after 01JAN2002.

Yes, for the substitute labor, they use PD of substitue labor and would likely get approve 485 if it is before 1/1/02.

Please be informed for substitute labor the I-140 filing date is the Priority Date and not the Substitute labor PD.

As far as I know,
If no I140 has been filed for the original alien, then the substituted alien gets the original LC Priority Date.
If I140 has been filed for original alien, but withdrawn before approval then also the substituted alien gets the original LC Priority Date.
If I140 has been filed for original alien and it was approved, then the original alien retains the priority date. The substituted alien will only get I140 Receipt Date as Priority Date.

what I learned by reading the froms here is even for substitute labor case, the PD is substitue labor date. It is not 140 filing date

Wanted to know, what you are saying is completly opposite with your signature!!
You are saying for the substitue labor, the PD would be 140 filing date if 140 approved. But your signature has PD of the substitue labor. Could you please explain this?

What insat 123 meant is Person X Labor and I140 got approved From Company A and quit the Company A and Join Company B. If the Person file I140 from Company B and Uses his approval I140 notice from Company A then Person X gets Company A labor filed PD.
