I am currently on H4 that expires november 2006. my lawyer filed 140/485/765 concurrently on the last week of august to the NSC.
on the 797, Received Date was 9/05/06; Notice Date was 10/02/06. When I checked the case status online, it is saying that the application was received on September 30. With the newly issued visa bulletin where visa processing goes back to Oct 2005 applications, how will my application and status be affected considering that my wife is no longer renewing her H1 status (and H4 for the whole family)? I come from one of the retrogressed countries and applying for Schedule A nurses, visa screen certificate and medical examination submitted. My wife and I are still waiting for FP appointment. We will appreciate any input. Thank you very much.

You can receive EAD that will authorize to work both of you. You can renew every year untill you receive green card.

Green card will be issued only when priority date will become current.

It is advisable to continue maintain H1B status beacuse
a) if principal applicant laid off, it is easy to transfer H1B. I 485 can also be transfered after 6 months of application.

b) You all are safe if I 140/I 485 rejected

yes we filed for EAD & AP with 140 and 485 concurrently, all received 9/02/06. i've read somewhere that once the EAD is used, the 485 applicant can no longer go back to H status (especially for the H4). -please correct me if i heard it wrong. i am counting on an EAD so i can move to another job. thanks for your inputs.
