Here is my detailed RFE

Experience: Submit evidence to establish that the beneficiary possesses the foreign expeience listed on the Form ETA 750 (Application for Alien Employment Certification). In addition, please provide letters, contracts and pay statements to verify the beneficiary worked for the listed employer. Evidence of prior experience should be submitted in letterform on the previous and/or current employer's letterhead showing the name, title and phone number of the person verifying the information. This verification should state the beneficiary's title, duties, and dates of employment/experience and number of hours worked per week.




nOW where will i get the pay statements from my indian guy. as per my records i have just one pay statemnt ....
also what do they mean by please provide letters, contracts and pay statements to verify the beneficiary worked for the listed employer. what should i give ???????

has anyone got such a RFE before

To start off I haven't seen or heard anyone get an RFE like this but below are my personal thoughts,

From the look of it one of the two things needs to change or is not working well for you,

1. Your case might have too many holes in it (basically to say it is not a very solid case to pursue). Now this could be any number of reasons, past job experience, present company, company size, educational background (mainly field of study as mentioned in LC).

Just to clarify what I mean by past experience is that lets say you worked for someone like IBM and you had a letter from HR with all the details I am pretty sure (not 100% sure though) your case would not had any issues like these.

While if you worked for some small unknown company back in India and the letter is from some previous colleague of yours more likely they might question your past experience..

Please note I don't mean to discourage you but just to share my thoughts.

2. Or your case was not prepared well which means the lawyer might have not done a good job in preparing your case.

Since almost everyone that I know (apart from the usual delays ...etc) has had no issues or they have the typical RFE's like ability to pay or relevant experience (this is more likely in a Labor substitute case). There have been rejections too due of one of the above reasons.

Thanks for ur response. Mine is a labor sub case and I have a bachelors in electronics . also i am preety sure that my education matched the other labor. also i submitted a exp. letter on the company letterhead earlier from HR.

My lawyer says that he sees this RFE very often and it might be because my exp. letter did not say whether a part time or full time job and number of hours. also my exp. letter says me as a software engineer. now i have offer letter from previous company plus i have tax recs plus i have performance review bonus plus i have tax record under that company name in india. the only problem is that those say my position as asst. systems engineer. is that a big issue.

as per lawyer he says as soon as they receive this info they will approve my case since they havent asked for any company information. he says usually he gets RFE for company info which is difficult to tackle sometimes. but in my case somone might have misplaced the exp letter that i submitted or not read it well....

anyways pls let me know additional comments from ur side. i dont think my case is in a very bad situation
 
Labor substitute cases usually get a different type of RFEs.

If you have question about 'asst. systems engineer'. I would check the labor certification or ETA form 750 to check what is the original labor is about.

But please keep in mind that 'System' is a generic word, and it does not JUST mean Hardware or software. It can be anything that has input-process-output.

So i feel 'asst. systems engineer' not a big deal.

I am still concerned that they want to check your previous experience "could be something very trivial"....
