Hi
I have a few questions-
I have 2 1-140's approved.

An EB3 concurrent 1-140/1485 at NSC which was filed in Aug 2003 and approved in March 2004. waiting for 485 approval.

An EB1EA filed at VSC in Jan 2003 and approved Oct 2004.
My lawyer is suggesting that I go for consular processing for the EB1EA.

Today he sent me some forms DS-230 Part I DS-230 Application for Immigrant Visa and Alien Registration Part I Biographic Data and some others to sign. Is this part of packet 3?
At what stage of CP am I? Will my I-485 be considered as abandoned?

Since I have been AOS for a long time now, my knowledge of CP is very restricted and I would really appreciate all the help I could get from all of you gurus.

Thanks in advance.

DS230 part I is a part of Packet3.
Once NVC (National Visa Center) begins to process the application, it will request your approved I-140 directly from USCIS. If you have a pending 485 based on that I-140 USCIS will withdraw that 485. In your case the pending 485 is NOT based on your EB1 petition, therefore there should be no problem with your pending 485.

Thanks so much for your reply.
Does me getting the packet 3 mean that NVC is processing my case or does that happen later?
Thankyou again.

Nope .... the "processing" is checking your DS230 Part 1 (part of Packet 3) - after you send it in.

What does that mean?

I have been AOS all this time, so suddnely when my lawyer brought up CP i was very unprepared. Thanks to people like you who help and contirbute to this forum, I am slowly starting to understand it all. So Thanks again.

Please go thru the postings - this info and other relevant ones are available.

I have read a lot of postings now and am getting a little more clear on the Cp process.
If I have CP with one I-140, can I still use my Advance Parole papers from my other I-140/I-485 petition?
Thanks.

hey aonflox

Hello
I just read your postings and I was surprised to see that I had the same questions. I spoke to 2 lawyers and got 2 suggestions. One said to go with CP as it would be faster, and the other said to go with 485.
I myself am inclined towards CP.what did you decide and what kind of time frame you have been given to get a green card through CP
best of luck

My lawyer says I can go ahead with both options until I have to make a choice. Aparently we get some sort of letter and we can choose. So I am going ahead and then waiting to see what happens. I want to go with CP since it faster. I just got my I-140 EB1EA approved in oct 2004 and on Jan 7th 2005 my attorney recd packet 3. Thanks and ket me know what happens.
