New rules of 140 and 485 and AC21

Now according to new rules one can file 485 and 140 togather. How will AC21 work on this condition if 140 is still pending for 180 days and second if cleared before that how will 180 day rule work . Is it from the day you file 485 or from the day u get 140. Any one with any views and ideas.

I don't think INS has thought about that so far. Basically they will make up things as they go. IDIOTS. There is no guidance on those lines is what I'm trying to say.

Frankly, I think that concurrent filing is not a good rule. I know lot of people who benefit from this will get mad at me for saying that, but thats how I feel. Because, this will
a) Not help those who are filing now, and
b) Create extra backlog for 485 waiters, might even retrogress priority dates, and
c) Introduces complexities that are conflicting with AC21 (are they following it anyway).

Also, from what I've seen, you change jobs on EAD and POOF Guaranteed RFE. You change address, POOF guaranteed RFE. Basically you do anything askew of being a perfectly clean young little boy, which is impossible in most circumstances given the lengths of their adjudications, you get a 2 month delay thanks to RFE. This stinks.

By the time these 140 filers (and now privelliged 485 filers) reach their 485 adjudication .. 2 years from today ... AC21 would be a definite no no because the way things are going, they don't want that happening, and they will keep tightening the noose with their crazy stupid idiotic irrational rules until no one would be able to derive any benefit from AC21.

What this amounts to is, you had 1.5 year of jail time, now you 2 years of jail time, and others who've already spent their 2 years .. get 6 extra months, for INS goodwill sake.

But yea, Atta and Shehhi will get their visas in time. Sure.

Sidenote: It's friday folks .. someone get approved darn it !!!
 
Looking from a different angle

People can get out of their employer(exploiter) clutches a little sooner than us as they can apply and get EADs along with their 140s.

As I typed in my previous message. INS isn't exactly following AC21. Change employer is a 100% guaranteed RFE. As time goes they are only going to get pickier about who qualifies and who doesn't. Know what I mean?
