New Policy for H4/H1 >>Please help

Is this true that to apply for H4 visa stamp at consulate principal candidate (H4 holder) must have his H1 Visa stamp in his passport. Is this a new rule. I know people's wife got visa from back home consulate where principal candidate does not have visa, but have the valid H1B approved notice.

Is this not true anymore??

I am converted from F1 to H1, never had H1 visa in my passport. Cannot my wife apply for H4 from back home?? I heard that as I dont have VISA, she wont be issued visa. This is fairly new policy.

Does anybody has any idea on this.

Don't think....

the visa stamp is essential. Unless the rules have changed...which I don't really recall.

My wife applied for an F2 (Mumbai, sometime in June 02) based on my F1 approval notice and got it without problems. So, if you can, send her the original or notarised photocopy. Also, she must have her Marraiage Certificate. She should even qualify for the drop box.

I know that VISA stamp is not essential. However, my lawer has said that. I know she wont be aligible for drop box. Consular processing for VISA in my country (Bangladesh) is not as liberal as in INDIA. Also if any lady apply for H4, they ask for lot of wedding pictures besides marriage certificate. Just the certificate is not enof for them. Now if I get married by my own, no weedding, no pcitures, how I will show pics.


Lets see how it goes.
 
H4 visa issue

My lawyer told me the same thing:

In order to bring one's wife on H4, one need to have a valid H1-visa stamp on his passport.
