Hi
Is there any regulation or law that states that I cannot maintain an existing RIR application that is stuck in the backlog center while I make new PERM application? I dont want to convert the RIR to PERM because the PERM one is for a different job title and descriptions which likely means its not convertible
Every where I have read indicates that if you attempt to convert and it fails you lose your priority date and possibly the ability to apply for a 7th year on h1b (if PERM apps started after 5th year)
However, what if I dont attempt to convert the RIR to PERM? In other words what if I just filed a new PERM as if I have no other pending application??
Thanks
