I am a little confused with the H1B Cap-gap extension under the new OPT rules.
I'm currently on OPT which will be expired on Feb 14, 2009 (and I'll have another 60-day grace period to prepare for the departure which means I'll have to leave the U.S. before April 14). If my employer files the H1B petition for me on April 1, 2009 and the petition got selected, would I be able to remain working in the U.S. until October 1, 2009? In other words, would the new H1B cap-gap extension apply to those students whose OPT ended before April 1?
