New offer and EAD

My current job is very shaky and I have filed I140/I485 concurrently a month ago. Now, I got a good offer from another company, the condition is that I don't need spnonsorship. My lawyer told me that my I140 should go through fine. Could I just use EAD join the company?

YOu will be in serious trouble if your I 140 is denied. Dont take any rish just your lawyer said so.

You can change the job if your 485 cross 180 days and you have I 140 approval in your hand.
The new job should be similar.

Yup, you can do that. I know most people will say that 6 months rules and what not. But I know atleast 20 people who have done the same thing. After they get the EAD they move to better jobs and all of them have GC :)

I was laid off just after one month of applying I-485 in Sept 2002. My i-140 is just approved (Jul-16-2003). I am sending AC-21 letter now. It is really difficult to decide about quitting the job before I-140 approval. Think about RFE for I-140.

You need to decide it. It is your guts. No advices will help you. Safe is holding H1.
 
It is very risky changing company within 180 days of filing 485 and with 140 still pending.
In case u get RFE for 140, it is diffcult.
Also, ur 140 can be revoked anytime by ur sponsering company.
There are still no definite regulations about AC21.
So think of all the pros and cons and make a decision.
 
Thanks for all your support. My company is a public one ( I can download financial statement by myself), and they have a profit last year.

But hopefully I can hold my job until I140 approved.

your ead is enough. They will not ask for anythig else. One thing I might caution you is that ask them to give your "title" same as the one you filed for LC and I-140.

Thanks for the information. Other people worry about jobs because their companies are losing money. My company is profitable but they want keep the profit growth and cut divisions that are not profitable enough. No job is safe these days.
 
My EAD info.

I checked my EAD status.

On July 11,2003:

The Case was approved. We Order new card.

On July 16,2003:

The case was approved. We sent out the notice of approval

On July 25,2003:

On July 25, 2003, the document we made based on the approval or registration of this case was mailed directly to the person to whom issued.

Did somebody have the same experience in case status as above?

I changed my address at the begin of June and called BCIS to tell them my new address. On July 9, 2003, I called BCIS to inquiry my AP. At the same time, I also told them I changed my new address. On July 19, 2003, I received my AP from my lawyer. The address on AP is still my old address.

Tammy2, could you please tell me what is this ACT-21 Letter you sent. Where we could download and where we send this letter????

I am in the same boat too, it will be good if INS makes the rules little more flexible. Our lives just hang around these numbers....H1, 140, 485, we're like space age futuristic labor robots with stamp on our forehead...
