Hello All,

This is Raj. Freshaman on this portal. It is great that everyone is sharing their experiences. I am happy to be a part of this forum. As usual I have few questions that I always had but couldn't get a firm answer. Can anyone plese guide me through.

1. My company filed Labor (NJ) in July 1 2002. The DOL sent back the receipt date (the certified mail recept notice) that they received on July 4. Do you know if they send out a official notice, like they do for H1b. How do you find out if they actually received my application?

NJ DOL does not sends official reciept date notice.

At the best - it is a guess about your dates. Add 7 days to your certified mail recept notice. It should be within that range.

1. As I mentioned, the Labor certification was filed under RIR in July 2002. However, at that time, I only had a BS in Engineering degree that I obtained from the US. Also, had 2 1/2 years work experience. I have certifiactions on the tools that I have been working along with official training for the corporate training offices.

I have heard that my credentails might not help me qualify to get through the labor. SInce I applied in 2002, I have completed my MS. Can I modify the labor certification. Do you think my credentials be ok?

You almost embarrass me mk354. Please use names. Everyone is like you only and we are just trying to share info - none else.

Ask a lawyer for good measure before concluding. LC is a very fine process and only an expert can comment authoritatively.

However, I belv your credentials may not be able to get you thru.
 
Sorry jharkhandi !I didn't mean to embarass you. Thanks for your advise, I will check with my attorney. I was told that my GC was filed under EB3/RIR

You may not "upgrade" your LC to include MS. You will have to start a new application for using MS to get into EB2 (with a possibly different job position/description, which requires MS as the basis for the job position). LC application is filed for a particular post, not a person. In your previous filing, your company would have advertised for a particular position, which requires certain quilifications - you cant change that without going through another round of advertising and recruitment drive.

Since I am under EB3 / RIR. BS (Engineering) + 2 1/2 Years experience will suffice?

Can I file for another LCA (based on new job req) to come under EB2? What are my options? Can you please advise?

You can find another LC - if it is not for the same position, same company and same state.

If any one is different - yes you can.

I receive so many emails these days offering pre approved LCA for few thousand dollars. Don't know how reliable they are. My comapny is pretty good but it is in NJ state and that sucks.
