New marriage, ready to file. Help with checklist.

I am un US Citizen and live in San Diego. I have been dating my wife for almost 10 years now, and since San Diego is a border town, my wife have been crossing with a normal tourist visa.

Anyways, we got married here a month ago, and just gave birth to a girl on the 22nd. The baby was born here in the US.


Now Im ready to file to get her a GC, from what i have been reading. I need to summit the I-310 and the I485 which can be done at the same time. Is there anything else i need? or those two are the only ones i need?

I know AP is optional and is only if she needs to leave the US, as well as the work permit?

Anything else i need to take care? DO i need the afidevit of support too?

Oh the fact that we got married when she's still on a 10 year visa can complicate things?

The main forms here are the I-130 and the I-485, but that doesn't mean that's all you need to send. The I-485 requires an affidavit of support, i.e., I-864, as well as a sealed copy of the medical exam -- I-693. So these need to be filed as well. The I-485 and the I-130 also require the biographical info sheets (G-325A) for you and your wife -- I think the I-130 requires both your and your wife's G-325A and the I-485 requires your wife's. The I-485 and the I-130 both require fees, though you should send a separate check for each. (Do be sure to include the amount of the Biometrics fee in the check for the I-485.)

So: you need to send I-485, I-130, I-864, G-325A for your wife (two sets) and for you (1 set) along with fees and supporting documents. They should all be sent in one package to the Chicago lockbox. If your wife needs advance parole to travel outside the country while her application is being processed, you also need to file the I-131 with the relevant fee; if she wants to be able to work before she gets the greencard, you should file the I-765 for employment authorization along with the relevant fee for that.

You won't need the I-864-A if your income is 125% above poverty level guideline.

If you are not financially eligible to sponsor and will need a joint sponsor (they have to fill out I-864 ), you can request a FEE WAIVER.

There is no fee for the I-864 or I-864 A or

There is a fee for I-130, 1-465 (plus biometrics), I-693, and I-131. you can find the info at these websites:
I-130 = $190
I-465 = $325 + $70 biometric Fee
325-A = $0 (they are to be filed as part of the I-485 package)
I-864 = $0
I-693 = $0 Fee but there is a doctor's fee $125 - $300 (depends on the doctor)
I-131 = $170 (optional - file if planning to travel)
I-765 = $180 (Otional - if wife is not planning to work until green card is received) If she is to work then you must file.

File all these at the same time
