Hello all,
I recently changed my company and got approved for H1 transfer. My wife is on H4. Her 3years H4 was extended with my 3years of H1 extension with the old company.

When I transfered to a new company her visa was not transfered as she is dependant on H1 and did not have to be transfered to new company.

Our visas have expired in passport and she is going to be travelling out of the country very soon with H4 I797 extension document with valid I94 until the visa expiration, which is in 2010. She will have to apply for visa stamping at US Consulate in home country.

I am not travelling so my visa will not be stamped. Are there any risks involved in having my wife travel and have her H4 stamped while mine is not stamped and my company has changed since last stamping?

I would appreciate your help.

Thanks.

I think, If she has a copy of your new I-797 and related documentation like offer letter, recent pay stubs, job continuation letter etc.. during stamping, it should be fine. There is no need to have your visa stamped.
