I was physically present in US on H1B /L1B for a period of 4 years from 2004 to 2009.
After Staying out of US for 16 months my employer filed Cap Exempt H1 for the remainder period of 2 years. I re-entered US during Mid of 2011 and can continuing until mid of 2013. 6 year time frame on this H1 will be expiring by mid of 2013.
Considering my stay out of US for a period of 2 years from 2009 to 20011, Am i eligib;e for a New H1 to be filed in 2013 April for which employment start date is October 2013.? Does any one have a confirmed clarity on this ?
