I recently converted from a valid F1 to a H1B status. My H1 has been sponsored by a company of which I am the only employee. I work as a consultant with the Government but since the contracting company had clearance issues this company that currently sponsored my H1 was subcontracted the work to bring me onboard. I intend to travel for a vacation to India in early January. My F1 visa is now expired .For a lot of my friends this seems to be one of the big reasons for a denial of stamping in India
However I have been advised by my lawyer to get my new H1 visa stamped in my home country (India) for re-entry to US.
1)If my passport was issued from Hyderabad but I received my F1 visa from Mumbai Consulate then am I eligible to apply for H1B stamping at the Mumbai Consulate?
2)What is the process for getting my H1 visa stamped?
3)What is the estimated time for the completion of this procedure?
Others yet advise that I go to Canada or Mexico and get my visa stamped before I go home .
