New Green Card Application

My original H1-B is expiring 30th Nov, 2009. However, due to an earlier pending I-140 application, I have an ext till 30th, Nov 2010. That I-140 is denied because of ability to pay.

I am with a new employer now. Am i correct to assume that if i start a new GC application before 30th, Nov 2009, i'll be fine.

Please suggest.

If you apply before 365 days of expriring your H1B in 2010, than you will be able to get one more year extension. I think that you have enough time for new perm application.

Do you if USCIS may consider the original expiration date for the new labor certification (30th Nov, 2009) and not the extended one (30th, Nov 2010)?
