New Company - GC

Say, I register a new company in the name of "xxx Inc or Corp or whatever" How soon I can start filing the LC? is that based on revenue or # of years old company??? ....

Appreciate your responses.
 
You can start applying anytime you feel that no willing/capable PR/USC is available to do the job you are petitioning for. But be prepared to answer a lot of RFEs on "ability to pay" etc. etc.

Also you cant apply for your own LC/GC under employer sponsorship (from your company).

And there are precedents where

applications are rejected (and affirmed by BALCA), where the first/only employee(s) happens to be a foreign national(s)! In other words a continuing entity can file a LC, not some thing (or seems like one) that started solely for this purpose!
 
Just adding to 001's post: you may also get a verification of existence of company(esp if you are in Nebraska/Vemont). Someone may visit you in person.

Regarding the verification of existence of company, how about the home office in Minneapolis, MN with few consultants working in client place?

By the way Jharkhandi and lca_001, do you guys know each other in person? I see lot of fun chats you guys having yourself in this forms?.

What piece of information are you trying to point to? I think in the complaint forum every one knows that FBI finger print check hardly takes much time... I too am being tardy in visting this site due to some additional work loads these days..

001 - did you read how much time FBI takes to do security checks? Maybe you would like to present it in complaint forum. I am off due to some personal reasons from that place.

Just based on the current chatter around RFEs (not based on any legal grounding), you may have a bit of a problem if you dont really have a good office setup, talk to a good immigration attorney - if your company and your LC are in good faith you (or your attorneys) should be able to fight it out (though it may be a bit difficult, based on the current suspicious environs).

Woah!, this is very good material - lets see how USCIS can now claim that security checks are holding up the process..

But as I think about it, I think USCIS may be setting up its own security checks - dont tell me that they have 1000 employees just shooting off mails to FBI and collecting information. I saw some mention about setting up a common database so that USCIS can automate its query process - Funny, because since late 2001/early 2002 USCIS has stopped mentioning about the common database.

Boy I hope there is some serious inquiry into the USCIS methods as they did for Condi yesterday (not that she said anything which was remotely true/helpful).
