Dear friends,

   When you talk about I-140 approved for CP, how do you know? I am asking because I don\'t know how my
   lawer filed my I-140, I don\'t think I asked him file for CP. On the I-140 approval notice it says "The above petition has been
   approved. We have sent it to the Department of State National Visa Center (NVC), 32 Rochester Avenue, Portmouth, NH
   03801-2909. NVC process all approved immigrant visa petitions that need consular action. It also determines which
   consular post is the appropriate consulate to complete visa processing. The NVC will then forward the approved peition to that
   consulate." then, it give the phone # and says"NVC will contact the person for whom you are petitioning"

   My question is does this mean my I-140 has been approved as CP? So that as Net posted, it will wait for
   NVC to transfer my I-140 back when they start processing my 485, and that will take extra long time? I filed the 485 and did
   not even think about CP.

   Friends, could you please check your I-140 approval notice and let me know if the above is just a routine
   statement for everybody? It is odd though it does not mention 485 form or AOS on the approval letter. I think it should
   mention both AOS and CP for your choice.

Then it is approved for CP , Even mine says the same , but still I applied for I-485. Just waiting for my approval.

Hi,

ofcourse your I140 has been approved for CP, your lawyer will soon get a set of forms from the NVC in order for you to
apply for CP in your country but you are allowed to file I485 if your are in US, at INS. when you file I485 you don\'t
need to do anything to cancel your CP, when INS processes your I485, if it finds that your I140 is with NVC then it
will make a request to NVC to send your I140 back to INS. when your lawyer gets the CP forms ( called Packet 3 ),
he will ask you whether you want to go for CP at your country, then you can just tell him that you want to go with I485
and just ask him to sent a letter to NVC that you would like to file I485, this might stop NVC from sending you I140 to
your home country. That\'s all, my case is unfortunately there is some delay in the approval, I hope it will be approved
soon.

Thank you kanti and Net. My 485 RD is 8/2000 and ND is 9/2000. After reading your post on this board, I double
checked my I-140 and found out. My lawyer didn\'t ask me anything at filing 485 time. When I ask him recently,
he said that your I-140 is in the US (NVC NH). I am just afraid that my 485 approval will be delayed like Net\'s.
From what I understand, if I don\'t apply for CP, my 140 approval will not be sent to my home country, i.e. at least
it stays at NVC even 140 is approved for CP. So it should not take long for VSC to get it from NVC. Correct me if
I am wrong

Net, when you talked to IIO, did he/she tell you that they are waiting for your I-140 sent back from your home
country or just wait from NVC? Since we have NVC\'s phone number, did you (can we) call NVC to find out?
Another question is when you applied for 140, did you ask for CP specifically? I think mine is approved for CP randomly.

I am also in same boat

My lawyer used old 140 form, so it automatically went to cp. But I want to apply for 485 here. If 140 approved in csc, we need to apply only csc or juridsection comes under place of residence for this type of case. Because if you check NVC automatic message, it always differentiates service centers.
