NelsonA: "Contract Employee" after "Full-time Employee"

HI Nelsona,

Hope you are well and appreciate your effort on this forum. My questions below:

- If an employer decides to issue a new TN (assume CSA category) for a full-time employee nearing their existing TN's expiry, and that new TN defines them as a "contract employee", won't that raise red flags? Both agreements could compared by the adjudicator? How to defend/explain that difference?
- Is a contract employee a 1099 or W2 or both? (realize independent contractor isn't permitted under TN, you've identified a particular self-employment option from the nafta guide)
- Is it a valid option to lodge a TN (W2) application, present it at the border where it is approved, and then later have the employer amend employee's employment to be "contract employee" from "full-time employee"?
- Won't the IRS notice that a full-time employee is being converted to a "contract employee", where it could raise flags around tax avoidance?
- For contract employment on a TN, does an applicant state that they are self-employed, yet they're working for their employer and lack company ownership?
