Hi Gurus,

I checked my I-140 approval notice and according to that my priority date is 24 april 2001. But my labor is substitute labor. Do you think I will get any problem in my I485 approval ?

without giving other thread link can you tell me by reading my post it will PD will effect me or not ? Because when I read other info still I am confuse.....

Hi nycindia,

April 24th 2001 is your orginal labor reciept date? or I-140 reciept date?

Hi valabor,

April 24 th 2001 is my original labor receipt date.
My I140 receipt date is March 17 2003 and I140 Approved in around July 2003.

don't worry. you are fine as your approved I-140 says PD "24 april 2001". That is your priority date so nothing to worry or to get confused.

I think by 15th January it should be clear, how they are going to treat substitute labor.

Till that time its all educated guess and speculation.

Going by PD date on I-140, you should be safe.

But what counts is how they treat it at the time of approving in the new scenario.

Hope for the best but be prepared for the worst...
