I am a postdoc in USA from Sept 2008. I did my PhD in Germany and applied US visa in Germany only. I came with J1 scholar visa. In my visa and DS 2019 shows that 2 yr HRR rule does not apply to my case. My visa and present DS 2019 will expire in June, 2010.
I thought I do not need the waiver to apply for the H1B. So that I submitted H1B visa application to my dept for processing. But the department official told me that I do not have the enough time to approve my H1B with normal processing. They told me that first they will extend the J1 for one-year and submit the H-1 application. They also said that once the H-1 is approved, my J-1 will be ended.
But I have doubt that If they extend the J1 for one year and apply for H1B. Do I need the Waiver to approve my H1B????. I am a citizen of India
