Need your opinions - through work or marriage?

As you can tell in the signature, my labor certificate was certified already but because of the wait expected, we decided to get my GC through marriage instead. My husband is having his interview to be naturalized next month. If he passes that, he will be able to sponsor me for GC through marriage.

Now that VISA became available, my previous lawyer called and asked if I wanted to file 130/485 on June 1. I asked which (through marriage or work) would most likely be faster. He said it would be about the same, all depends on FBI name check. I told him that I’d make my decision after my husband had his interview next month.

Here is a little comparison.

Through work:

1.My company would only sponsor if I use a lawyer for liability issue. There is a new lady in HR who’s now in charge and she is not too keen on this whole thing. It will cost me $2000 for lawyer fee.
2.I will be able to apply for I131 (?) and work anywhere else after 6 months
3.There seems to be a lot more paperwork involved (?)
4.There is always a chance that they deny if they get nit picky
5.I’ve already invested a great amount of money and time on this. I kind of want to see it complete. (Just a personal feeling)
6.There is always that risk of losing the job

Through marriage:

1.I already prepared 90% of paperwork and I plan on doing on my own so $2000 cheaper
2.I will possibly get my work permit in about 6 months and I can work anywhere
3.I went over the top on gathering the proof of marriage so there is very little chance they’d deny based on that
4.Marriage is never 100% secured either


My main concern is being able to work anywhere (as well as a second job) and being able to leave the country to see my mom – hopefully this December. Time of getting the actual GC is low priority as long as I have my AP and work permit.

What would you do if you were in my shoes?
 
I think the marriage route will be much less complicated and you can start to work in about 6 months. How long it takes the 485 to get approved is totally random. Some people have been stuck in the FBI name check for more than a couple of years. Your situation seems to be further complicated by your HR personnel not being too eager to help.

I would say that marriage route will be much faster and hassle free but if you want to file with the employer as a backup and can afford the extra expenditure then go for it.
