Need your help to apply 140

My employer has approved labor with old date(2001, EB2) and he is ready to use it for me.
The approved labor matches with my experience and job description.
How ever it didn't exactly match with my education.
The labor required the education of M.S or equivalent in computer science, but i have M.Sc(Mathematics) from India and PGDCA
(Post graduation diploma in computer applicatioins).
Do i have really good chance to use this labour and apply for 140 directy? Please let me know.
You honest opinion is greately appreciated.
 
What do you mean by MS or equivalent in computer science? What is the exact wording there?

My honest opinion, no chance, or extremely hard, you do not meet primary requirement and you do not have MS in computer science. But of course, it all depends on how the approved perm is worded. Please provide more details.

College Degree required
M.S. or equiv.
Major field of study
Comp.Sc or Comp.Engg.

My lawyer says he can do the educational evaluation and prove that my degree M.Sc(Maths) + PGDCA is equivalent to M.S com.science.
Since the labor says M.S or Equivlent, my lawyer says we have very good chances.

Can i believe my laywer. Please help me friends.

It is my opinion that MS or equivalent refers to the degree itself, but no to the major of the degree. It does not say that the major could be equivalent to something else. It simply says Computer Science or Computer Engineering. I think the best way is to redo the labor. Of course, you can always follow what the attorney says and file I-140, and see what happens. Good luck!
