Any of your help/suggestions are really appreciated, the following is my
situation:

Received Green Card in April'02. Worked for sponsoring company from beginning of GC till July'02. Last few month (Jun'02/July'02), the sponsoring company do not have a project so joined a full time employer in Jun'02. So I have an overlapping in employment.

Now I am completing the N-400 application, do you folks recommend apply for N-400 now vs wait till Aug and mention only the new employer from July'02.

Just trying to avoid any complication in N-400.

Thanks and appreciate any suggestions.

Personally I do not see any harm, but ideally I would recommend you to show sequential employment as the interview officer may be intrigued to see the Employment overlap (which is not common afterall). Do you have Employment letters from the Original GC petitioner as well as the second Employer?

Shouldn't really be a problem. It's certainly not illegal to work for multiple employers at the same time (as long as you're a US Citizen or Permanent Resident).

As long as you didn't have any contractual obligation with either party that stated you could not work for the other, you'll be fine. Even then, you're likely in the clear.

Good luck!

In my case, during the Interview, the officer asked for employment history for the past 10 years!!!

So even if you apply and show only the new employment the officer during your interview can ask questions about previous employment.

As long as you have papers from both employers, go ahead and apply now. There is no need to wait till July.

If asked, during the interview present all documents and explain.

last 10 years? why?

Hi N400,

which DO did you attend interview? why did he ask for last 10 years?(just curious).

Thanks in advance

A guy posted here a kind of internal manual for IO last week. In that manual, IO is asked to see if the sponsor of I-140 is listed in you employment history. If he/she does not see it, you will be asked some questions to explain. So I guess no matter when you file, you need to prepare for the question.

The Adjudicators Guide specifically states that IO's should verify whether the candidate was ever employed by the company sponsoring their GC (if applicable). No time frame is specified, so expect the IO to go back as far as necessary if they believe there may be something fishy going on.
