Recently, my Canadian Immigration got approved and the deadline to enter Canada is June 11, 2006. I want to go to Vancouver, Canada for 1 week and comeback to USA. My situation: US immigration I-140 pending, Advance parole approved. My question is:

1. I have H1 approved until July 14, 2006 both for me and my wife (H4) but not visa stamped in my passport. Do I have to go to US embassy in Vancouver, Canada to get H1 and H4 (for my wife) stamped before entering to US again.

2. or can I enter US again with the advance parole? I exactly don’t know how Advance parole works, do I just have to show it to US immigration officer at border or I need to go to US embassy in Canada?

3. Shall I wait till my I-140 gets approved (April/May)?

Please advice me accordingly. I am just worried if there will be any problem getting back to USA.

Thank you so much.

Are you sure? What I think is AP cannot be approved before filing for I-485 - the AOS, which cannot be done before I-140 is approved.. And you are saying your I-140 is not approved....does not make sense...

Nope, you can use the AVR depending on your country of citizenship and if you have an expired US visa in your passport...

If you really have advanced parole (which you cannot get if your I-140 is still pending or have you applied concurrently???), u do not need to go to US embassy.

You could do this, but it is not necessary
