Need your advice/Help

Hi Folks: I am US citizen and fild for my wife AOS on 23rd of dec,2008. I received RFE for the joint sponser witch i have sent them back on 3rd of Feb,2009. I receved my AP and EAD card on 25th of feb,2009.My cas is with MSC and after sending my rfe answer i received an e-mail saying that i will receive decesion in 60 days which have already completed. My wife came in this country on student visa and her i-94 said D/S on it, but she quited the school almost two years ago( her i-130 was aproaved in feb 2005). Now we are planning to go back for three months to pakistan(summer vacationa)with our three kids(also usc). I am afraid that on our way back she might have trouble to enter us, we are all comming togather in same flight. second thing that i have checked with info pass and they says that that my case is still with MSC and they cant expedite the case while it at the MSC. the only thing they told me you have to wait or if u get interview letter in you absence then i can request reschedule the interview, let me tell you one thing that i have booked my tickets too( expensive) so wot are your sugestions and wot do u think how long its gona take to get interview( any idea) i am in washington dc DO.

If I were you, I would by NO means reschedule the interview, period. The vacations - they can wait, the tickets - I can reschedule or cancel, but missing or rescheduling an interview with USCIS, that it is a no-go zone. Just search this forum and read people's experiences after they canceled on USCIS.
 
come on guys.........

Can some one share experience to returning on advance payrole and have D/S on i94 card and f1 (student) out of status. on pending i485 aos(family bassed). Any experience will be highly appriciated.
 
When once you file for any immigration benefits/change of status, your non-immigrant stauts expires automatically. She is no longer and can never be an F_1 anymore. So forget about the whole D/S on I-94 thing.
The only thing she has now is her AP, she must obey the rules and regulations as stated on her AP for a succesful reentrance.
On the other issue, it is always best to at least know the date of your interview before travelling. If you do travel and missed your appointment, it will be classified as "abandoning your application" and any other immigration fillings could be detrimental due to that..
So think again and prioritize your needs, and then go from there.
 
Also about loosing status, she is now married to a US citizen, so that will be forgiven, although she should prepare a viable reason while she was out of status incase the question comes up during you guys interview.
Her status now in the US in "Pending permenent Resident".
