Need urgent Information on Labor substitution

Labor Gurus,

I am going to join a Company which is going to use labor substitution for me.

Existing Labor requires Masters in Compuresr and two years of Senior Programmer and One year as an Architect on or before Jan 2000.

I have Masters in Physics on July 1994
And have experience of 2 years till 1996 from a company in INDIA which doesn;t exist any more.
From then on I went for Masters in Computer Science and got the degree on July 1998. From then on wards I have been working in the companies which is still in the business and well reputed.

Question is

Would I be eligilble for approved labor. If i get experience letters( for 2 years) which is prior to Masters in Computers (which is required for existing labor) plus experience after my Masters in Computers till Labor Application Date(1+ years) and experience after Labor Application Date(4years).


Please let me know If there is any other better way of using in this scenario.

First of all, if you are unable to verify your employment experience with the company in India that has gone out of business, this may be problematic, unless you get that verification through a former manager, supervisor who worked there with you and can verify your experience.

Secondly, if you are unable to do this, and are relying on the work experience with the company which is your current employer and which is seeking to use the already approved labor certification, this may not work. You can only use work experience obtained by a company OTHER than the one sponsoring your GC application. The reasoning is that if the work experience is truly a prerequisite for the position as stated on the LC, then you must have had that experience before being hired by the company for that position.

Let me know if you have any additional questions, as I have done quite a few of these labor certification substitution cases for my clients, when possible.

For Master's
1 -After completion of Master but before filing of LC not approval (Be careful)
2- After completion of Bachlor (assumed 1 is included either gained experience simultaneously or with gap)
3- Only Computer Science Major is applicable.
