Need URGENT help on visting out of US on AP

Dear All,

I have to go to home country (India) due to personal reason and am going after almost 6 years, I have my i140/485 pending since Dec 2004 with another company who is not holding my H1 . My current employer who hold my for last 4 years apllied three H1 extenssion based on 140 approval got ref due to company info (although I still with same company).
Now I have AP based on my pending i140/i485, so would I'll havew any problem entering back to US, since my visa is expired on passport.
I am very nervous. Please shed some light I am schedule to fly out on March 16th.

I didn't completely understand your H1 & 485 situation But as per my understanding, as long as you have unexpired AP you should not have any issue re-entering US. No matter what your H1 situation is... since AP is based on your pending I-485 only..

I think your should be FINE... confirm from your lawyer though!!

Don't worry too much, you are going to be fine with AP. Just pack copies in the different bags so you don't loose them all at once.

Don't worry too much and go to you home country and come back with AP (just check when it is going to expired).

travel to home country

I have not been at home (in Russia) for 7.5 years. I got AP two times before, and never used it. This summer I MUST visit Russia for personal reasons. I have just got a notice that my third AP has been issued. But I am still scared of risking, because my name check for I-485 is still pending (close to 30 months by now, by the way!) In May I must apply for EAD renewal, and I am afraid that while I am out of the US, they might invite me for another (4th) fingerprints or interview regarding AOS (though normally EB2 applicants do not have interview). Do you think it is reasonable for me to restrain from any travels until I get my green card?
