Hi, My BIL who was on h1 lost his job in dec and moved on to his EAD. He got another job in Feb.
But when my BIL's green card was applied my sister was out of country and couldnt reach on time, so that her GC could also be applied for. Now my sister was living here on H4. But Since my BIL lost his job, she became out of status. In first week of April she went to out of US to get her visa stamped.
My questions are:
Can she get her h4 stamped?
Can she come back as a dependent on my BIL's EAD?
Will she be penalised for being out of status and still living for 4-5 months in US?
If she cant come back as a dependent then what are the ways she can come back to US?
