Need urgent EAD for wife's STUDIES

Folks,

My wife needs an EAD to apply for medical residency in the US. We have our EAD application pending (receipt date Aug 27th). We know we will get our EAD eventually. But the problem is more complex.

For medical residency, programs call candidates for interviews in Nov/Dec. So they start offering interview slots in Sep/Oct timeframe. If you don't have an EAD card or EAD-approval notice, they will not even consider you. They don't care if you say that EAD will definitely come by Dec (or something like that).

We tried our local congressman, but even he said he couldn't do anything
until the 90-day processing time had passed. We tried the local INFOPASS office and submitted an expedite request, but that got denied.

So we are urgently looking for ways to get my wife's EAD ASAP. If we don't get the EAD in time, my wife will lose an year and in medical residency, every year you sit at home counts (against you).

Does anyone here have any ideas what we can do ! Note: This EAD is needed for *education* purposes and not for *gainful* employment.
 
Your wife should just let the programs know that she will be joining on an EAD, which is expected in next few months. The residency match results come out in april, so more likely than not, she will have EAD by then. Many programs know the way uscis works based on theri interactions with FMGs. So dont worry too much.
 
Most programs don't want to deal with this. They want to see a copy of EAD card before they invite you for interviews. We already have seen 3 such cases already...hence the worry.
 
Until 90 days have passed, there is really nothing you can do to expedite the EAD.

However, you can seek the advice of the lawyer to find a way to convince the schools to interview your wife with the pending EAD. Maybe the up-front refusal to accept the pending I-485 and EAD application, given that the EAD will be approved or denied before the residency actually starts, is a violation of one law or another.

Me and many people i know were invited for inteviews from India and came on B1 visas, did the interview and joined on H1B or J1. If programs dont want to gamble on her getting an EAD through you, she can join on H1B.

Not true.. my wife is an resident. She got couple of interviews even before we applied for 485. The one she got residency into .. George town university asked for the EAD card after 1 month into the program.
There were couple of places where she was interviewed said that they can do the H1b too .. as most university and non-profit hospital do not have a follow the quota system. In one interview -- Wayne State (Anesthesia Dept) the PD asked if she had got the EAD card with her. She said that it might come in a months time .. The PD said that they generally give 3 months of extension to join .. if the EAD or h1b is delayed.

So do not worry about it .
 
Getting impatient

I think the original questionner is simply getting impatient and panicky. No where in US ( most programs/employers) ask for physical work authorization card at the time of interview. But than FMG's especially from India, suffer from panicky habits and want to have everything in hand before doing anything.

Simply attend interviews ( ur wife, not you) and put the best foot in front of them. Her intellect and good scores are going to get her residency. A lot of doctors come from India without anything in hand except positive atitude, will and good scores ... and make to good programs. Remeber, even in scramble you don't have to carry around physical card. They believe you when you say you have EAD.

Just chill ... be patient!:cool:

Of the 3 calls received yet, 2 have already asked for EAD-card copy before
they assign a date for interview. I guess either times have changed or other
folks have just been plain lucky!

I think they are from New York area -- If so it might be good idea not to go there anyways.
