Hi all,
I have already filed for my I-485 and got my EAD. My 1st H1-B has already expired last September, but i have the approval notice for the 2nd one from the INS.

I need to travel back to Egypt (my home country) in the beginning of may for business purposes. I have 1 of 4 options:

1. Send my my passport to washington DC to get a new stamp, lawyer is saying that might take up to 17 weeks.

2. Get my visa stamp, that will for sure take a long time.

3. Go on advance parole.

4. Go to Canada to get a new visa stamp. I'm worried about the consequencies, if I don't get it.

Anybody with a similar experience from any country, please advice.

Thanks a lot

I dont think you can get H1 revalidation

in the US. At least thats what i remember reading.

So if thats the case you may have to go to Egypt for a stamp. I wouldnt recommend Canada. Again why do you want to risk H1 stamping when you can safely do so with AP.

Easiest would be to use the AP.

Good luck

What is the risk in H1 stamping, can you share any experiences. I'm in similar situation, planning to go Chennai (India) for stamping.

Its just the same risk for F1.

If something happens and the officer decides to screw you, they will.

Nothing specific.

AP when leaving home country

If I decide to go with Advance PArole, do you have an idea if you home country checks whether you have a valid visa stamp or not. I'm just concerned that they will not understand the whole AP deal and for some reason they decide not to let me fly back.

I think if you use AP while travelling, your H1B will be voided. So if your GC is rejected or something happens, you won't have anything to fall back.

I don't think using AP will void H1B, it gets inactivated. You can get the H1 stamped and then activated by reentering into US with a valid H1.
