need to go to another employer! Pls help

Hi

I am on my 7th year of H1 and my labor is in the backlog center. I now would like to move to another employer as my current employer is creating problems with salary.

1. Is it possible to switch employers in the middle of your labor/GC processing?
2. If it is possible, what risks are involved?

Any help would be appreciated.

what are you intending to do?
1. File another labor?
2. Continue with the existing labor?

Is it possible to continue with existing labor with another employer? Or is it necessary to file a new labor?

Can continue labor with existing employer. That company should be ready to continue it. If you leave them then why should they process the GC? What incentive do they have?

All these companies are blood thirsty and out to suck your hard earned money. So think a bazillion times before taking/making a hasty decision, because you are in the 7th year of H1B

Are you talking about I-140/I-485 application? That's a different story. It depends how old is your case. If your I-140 was approved but I-485 is still pending you can leave. If not, you are stuck. You might want to talk to a lawyer. Until a few years ago, we had to file I-140 first, wait for the approval and then file I-485 and wait 6 mo before changing jobs. Now, with the concurrent filling, is different... Make sure that you are safe!

In your place I would contact my Congressman and ask for help.

Are you talking about the Labor Certification???? The new company CANNOT continue your Labor application. They have to start all over again.
The new employer says that they can start a new labor in PERM with the same priority date of my current labor application which is in 2004. I was just wondering if this is possible.
 
I have the same question. I have an approved labor from a business that has closed its doors. I am getting ready to file a new PERM application, Is it possible to retain the previous approved PERM labor PD from a new, different employer PERM petition? If yes how do we do that?

I don't think that they can do that. I would advise you to contact a lawyer. Laws change overnight, so, it might be possible....

You will need to consider the risk as stated before. What if the earlier PD is not given to you? There could be goof up in the GC process? Then you have wasted so much time and money (in reduced wages) for nothing?

It may be worthwhile to stick with bad situtation and get GC (in 2 to 3 years from now hopefully) and then pursue other options.

Think over this again. Do not look at short term benefits, you will loose much more in the long run.

All these links posted on murthy.com/ other websites do not have any legal binding. The USCIS does not look at these chats/forums to arrive at a decision in your case.

My 2 cents.
