Hi All,
I was searching in the archive mesaages but I couldn't find what I was looking for. First of all I have very little information about processing and I need some guidance from you guys. Here is the details of my case.

I married to a permanent resident in Dec 2001. I came here in USA on H1B visa in August 2002. After coming here immediately I file for I-130 (As one lawyer told to do so...). Till date I haven't received anything back from INS except my application reciept number. My wife became citizen recently. Now I came to know that now I have two/three options
1. I can file I-485 and I-765 immediately here in USA. I will get EAD within 3 months and GC mostly more than 2 years.
Here another question is after getting EAD can I change my employer? As I am filing I-485 - family based not employment based.
2. I can file I-485 here for consular service and will get interview call within 3-4 months in India.
3. Me and my wife go to India and apply from Delhi office for Immigration. This process will take approx. 4-6 months. During that period I have to stay in India. I will get my GC when I re-enter USA after that process.

I am not sure, for which process I am eligible, which one is good. I know all of the above process may have some pros-cons. Please let me know your view.

Thanks,
Dharmesh Patel

Your best option is to apply from India as there is no long wait there. You can apply I485 from here and you will get your EAD in 3 months, you can work anywhere, for any employer and can have any # of jobs.

Thanks for your reply.

But I have one more question your answer says its better to file from India and in Poll it says Consular Processing. Can you tell me exactly which option (1, 2 or 3 from my original post) you are suggesting?
