Need to apply for AP.. Please help

Hi,

I want to apply for Advance parole. My lawyer asked me $300 extra to file AP. So, I thought I will check with you guys, if I can file myself, then I will be able to save that money. Please let me help me in this, what forms I need to fill, and where to send etc, if I can individually apply for me and my spouse. How long it is taking in NSC now to get the approval for AP, any info would be helpfull..

I second grunggy's opinion.

No need to spend $300 on the lawyer ... you can easily do it yourself.
The form is self-explanatory.

If you search in the EAD/AP forum, someone even posted a "fillable" pdf of this form (the one on uscis is not fillable).

I'll do a quick search & post that thread here when I find it.

You can do it yourself if you are sure you have all necessary information and documentation. My lawyer charges $150 (for one person).

Thank you all for the responses and information. I am planning to file AP on my own, before that I have valid h1 visa till 2006 feb.. Visa stamping is there on my PP. So I am worried that do I still need to apply for AP if I want to travel now?? My lawer said that, it is better if you have AP. But she is also not sure whether just H1 visa will be enough or not..

You can most definitely travel on a valid H-1 stamp if you are still maintaining H status.
Jsut carry all of the relevant H1 paperwork with you.

Of course, your lawyer wants you to get the AP (its the $300 that's talking here !!!)

Seriously if you are from a retrogressed country, you are very safe traveling on H1 ... since your PD is not current ( and far away from being current), you have no chance of 485 approval when you are away from the US !
So go ahead and use your H1 for re-entry -- no issues.
