I have a situation that I need some advise from you guys....

I am currently on H1 status in U.S. I landed in Canada in Nov. 2001 with my landing papers and I made Social Security card during that short visit and soon after that I came back to U.S. My landing papers expired on May 2002 because of the 183 days rule. Now I want to visit Canada for 1 week in December 2002 for personal reasons....and my question is that should I get a visitor visa for myself or should I travel to Canada with my landing papers after all it has been over 6 months since I landed in canada.

Your advise would be greatly appreciated.

Thanks!

Law is retroactive

I called CIC couple of weeks back and they mentioned that it should be ok if we land after 183 days. Its common to all Canadian immigrants. You should be ok to go in Dec 2002.

Has Gumby lost his PR status because more than 183 days have passed?

I saw in the Immigration Canada website that:

Longer absences from Canada Under the new Act, permanent residents may be outside of Canada for three years in every five-year period. This allows permanent residents and accompanying family members to be absent from Canada for longer periods of time without the risk of losing their status.
