need some written proof abt concurrent filing -- pls help

I140helppls

I need some strong documentation for concurrent filing procedure to show to my employer that its not risky.
They say 'If u file the I140/485 is filed concurrently and the I140 gets rejected , There is no refulation explaining
what will happen. for e.g Can u go back to ur H1 status etc etc .'
However if you have only applied for the I140 u can go back to ur H1 and reapply ur I140 .

Though all of u know the exact reason which is they dont want the people to be able to use AC21 quickly,
I am looking for some sort of documentation to show them and make my case stronger for filing concurrently.
Pls advise

140 adn H1 have nothing to do with each other. If you are H1 you continue to be H1 irrespective of concurrent filing. I don't know how or when you exactly get converted to AOS. I would guess usage of EAD or AP would change your statusto AOS.
Also if your 140 gets rejected- nothing changes- if you were H1 you will continue to be H1. If you had 'changed' to AOS- get back to H1- by applying H1 again.
HTH:confused:
