I need some help from you all for filing my I-485. My labor was approved in Jan 2007 with priority date May 2003. I filed my I-140 in April and it is pending in Texas. Now that my priority date is current as of June I was hoping to file I-485. But my attorney says that it is not wise to file 485 when 140 is pending. They say that if the 140 is denied the 485 will be denied and that I cannot file 485 again even if I appeal the 140. What are the reasons that 140 can be denied and can I prepare now itself for any RFE that might come later. Can I apply I-485 again if my I-140 gets approved after one denial?My first H1B and educational equivalence was done by Attorney Murthy. The same thing was submitted for Labor and its approved. So will there be problems at 140 stage. Can I go ahead and file my 485 now? Please give me your opinion. Thanks in advance.
