I recently spent a year in the states on a B1 visa an a parole, my time has now expired but my brother who is a citizen has begun to file a I-130 petition on my behalf, my question is after the submission, do I have the legal right to stay in the US while this form is being processed??? Question 2: I was married to a US citizen, we have sinced separated an the marriage in the process of being annulled, does this effect my I-130 petition ???
