Hi,
My company applied for 140/485 EB2 Concurrent RIR in late Dec 2004. Since then, I have received my EAD/AP, and have FP done.

- I do not have my 140 receipt number as the company hasn't provided me with that. Is it ok to ask for the same? Exactly who informs me when 140 is approved, is it USCIS or my HR? IF it's HR, I would then think that the system is unfairly inclined towards the industry since I have no way of knowing if it was approved at all.
- Current processing time for 140 is Feb 01,2005. What does this mean? Does it mean that USCIS is still processing all the applications filed until Feb 1, or the ones after?
- If I suspect that my 140 might have been approved but HR didn't let me know, what information will I need to call USCIS about? Can I use my 'A' number to track 140 process?
- My company has changed lawyers since applying for 140. HR too has changed a little bit. Does this adversely affect my process?

I heard recently that 140 is now portable. Is it true?

Thanks in advance for any info.

Did you try asking your HR/attorney for the receipt number? I heard few companies don't reveal this information as the I-140 application belong to employer. If your company is not interested to reveal your receipt number for I-140, then probably they won't inform you on time when your I-140 is approved. You use FOIA to get your labor/I-140 details. It may take few weeks. But its worth waiting.

It means that USCIS is currently processing I-140 applications received until Feb 1st 2005.

I think you need receipt number to do this.

I don't think so. It won't affect as long as your attorney has submitted all required papers and act on time in case if any RFE comes. Make sure that your company has filed G-28 (I am not sure about this number) to change attorney information with USCIS.

Hope this helps.

Good luck.
