Need some ideas? The date of EB2 India current with my EB3 140 approval date

Hi, This forum is of great help to us.

Need some advise. The date of EB2 India is current with my EB3 approval date 140 approved with PD = Sep/2002. EB3 is at April/2001 (stuck). I am in a desperate need to do get my GC due to some emergencies in India. I just can not wait long.

I wanted to somehow upgrade into EB2 and use Sep/2002 as P.D and file my 485.

what options do i have ?

1) same company, upgrade EB3 to EB2?
2) Switch to different employer and file EB2 ?
any thing else positive.

what are the pros and cons ....

please advise.

You can do either with your current company with different job title or a new company. Wouldn't it take longer for you to find another employer to sponser you? Good luck!

If I do file a fresh new EB2 labor with my current employer but with a different Job Title say "Senior Software Engineer", then how would I show this Job Title in my experience letters now ?

When i submitted all my experience letters filing my EB3 140 (total of 6 years of experience prior to Sep/2002), the title on all my experience letter says "Programmer Analyst".

I have B.E with 10 years of experience uptill now.

I think you have to work out the detail with your attorney. the experience you earned from your current employ does not count for the eb2 expereince requried except it is 50% more different with what you will do on eb2.

confusion

hmm ...it seems that i have to switch my employer then. Can i ask you a quick question ?

it is the "title" of the position that matters the most or is the "actual job description" which differentiates between EB2 and EB3 ?
or both ?

in other words -- can somebody apply as "programmer analyst" in EB2 with it's matching job requirements ?
