Need some help..

Just a simple question for you guys. My friend overstayed his tourist visa for almost 2yrs and i just want to know if ever he can go back to his home country anytime? without having some trouble in the airport or any kinds (fines, detention or something)? He has a clean record here in the u.s., no criminal or employment record.

Really need your help guys. thanks!
 
Yep. Leaving the country is totally fine. Though if your friend ever wants to come back, since he has overstayed for more than 360 days, he will find that he now has a 10 year ban from the USA (clock starts ticking once he departs).
 
thanks guys. but can he do something to counter/remove the 10yr ban? how will he do it? thanks for your help
 
Nope. A bans a ban.
If he was in his home country and was married to a US citizen, then a hardship waiver could be filed- though this is very difficult to do as you have to prove that the US citizen is undergoing extreme hardship without having their spouse in the USA. Many US citizens end up moving to their spouses country while they wait out the ban.
The US is not very forgiving for those overstaying visas- time limits are put on a visa for a very good reason.....to overstay, one must do so at their own peril.
 
Your friend might see if he can enter Canada or Mexico, and fly home from there. Then there might be no record or proof that he overstayed his US visa.
