hi everyone,

was wondering if anyone can help me out here. my cousin and her husband got married in a civil ceremony in NY last year and her family didnt know about it. Now, her family is arriving for what is supposed to be the real civil ceremony next month. the civil ceremony will now take place in NJ as that is where they now reside. question is, is it legal to file for another marriage license, although in a different state but to the same man?

if anyone knows anything, your help will be appreciated. she is in a bind here as she does not want to upset her parents as they are very "old school"

I dont think you can get a marriage license from 2 different states . ( I just called my town office ) The marriage will have to be annuled before you can apply for a new license .
You might want to check your state law before you go to the town hall with your relatives .
In my case I dealt with CT - RI - PA and they would not issue a new license as we were married in another state .

Uhmm how people get on those situations? just tell the truth and say "hey we got marry already...do you want to go out to dinner?" :)

Seriously, they should check with their county office/town hall. I think you can do it, but some places ask on the form if you have been marry before...and then the answer will be "Yes" ...but you are not divorce, null nor the spouse is dead.

You cant get married a second time without terminating the prior marriage first, either by annulment or divorce.
It regards the privileges and immunmities clause of the 14th amendment. If you enter a new state with your marriage certificate from another state, the new state must treat your certificate as though they issued it. As such you can't get married again until you terminate the prior.

Why not just have the ceremony but dont sign any papers or apply for a license. If asked by relatives, just blame it on the way the US works.
