Need some advise - EB3 Retrogression

Hi all,

I have finally made up my resolve to move back to our homeland India for now.I am not sure at this time if I may want to come back.

However, my employer is willing to let me apply for the GC by consular process in India whenever my PD becomes current ( I-140 is cleared) and also has options open for me to get back if I want to.

My question is : What are my chances to get a GC if I go back now and appear for the CP interview in India whenever my PD becomes current.

Please share your thoughts/facts.

I have my second H1 valid until May 2008 and my PD is Jan 2003 EB3.
 
UN - I will always keep in touch with my company attorney. So of my H1 B is valid while I apply for consular process then am I ok ?

Gentleman,
My current status is as follows:
I-140 approved
I-485 apped Dec 02
PD Jul02
EB3 India

Currently H1 (6 yrs) will expire in Apr07. Co will extend h1 for another 3 yrs

Plan:
I have no time to sit and wait for GC,i have admission offer from a top european school in Europe.
Co is willing to provide sabbatical for one year.
I want to complete my MBA this year 07-08.
Now, whats your thought?

Can i do this?
( I have EAD and entered on AP many times)

Questions:

(1) Can I do this?

(2) For example classes start in October07 andmy EAD/AP expire in DEc 07. so can i apply for extension before i leave US>?

(3) can i re-enter US in dec for vacation? ( Wife to continue education in US on 485 pending status)

(4) To re-enter what should i use? H1 or AP? In the past i have entered on AP
