Hi all,

I need some advice regarding the 485.

My receipt is wac-02-232-xxxxx
EB2 case
RD: 12 July 2002
ND: 15 July 2002

I need to go to india for a about 2 months in October and will be coming back in December.

1) what are my chances of getting approval by then.

2) If my case is approved while I am in India will I have any trouble coming back to US on H1

3) I will also be applying for my H1 visa. Would I have any problems getting the visa since I have applied for Immigration here. ( I dont way to take chances with AP coz it might not come by October)

4) Can i apply for AP from the local office. I have AP but it expired on 08/01/03

I would appriciate if you could give me some advice.

BTW The trip cannot be cancelled.

1) afraid the chances are very low; this answer should obviate the other qs but...
2) If you have AP, there will be no problem; Will leave it to others to comment on reentry with H1 after approval.
3) No. (easily no that is). H Visa is dual intent blah blah... However watch out for Visa interview delays. Try to make an appointment now for the Visa date.

i agree with neeru. dont enter on H1 if u get an approval when u are away. make sure u have valid AP and EAD when u enter back.

I already have an AP which was valid till 08/01/2003.

Is it possble to go to local INS office and get an emergency AP or something.
