Need some advice on name of spouse

Hello everyone,

I am almost ready to file my N-400, but I am a little confused on what to put as the name of my current spouse. Let me explain: She has 2 kids and a grandchild from her previous marriage and we are taking care for the grandchild. Because of the grandchild she is using her middle and last name from her previous marriage, it makes everything easier when dealing with paperwork about her children and grandchild (same last names). She also uses the same middle and last name in her driving license. Is this the name I should use in the N-400 form, or the name on her birth certificate?

Thanks in advance for any ideas and help!

Hello again,

Ok, I called the US CIS service toll-free number, and they said I should put the "name given at birth" or "name taken with legal action". My wife uses the same name everywhere, driver license, bank accounts, mortgage, loans etc. Wouldn't that be her "legal name"?

Did she go through a legal process to change her name? If not, her legal name (as far as USCIS is concerned) is her birth name. If in daily life she is using her middle name and last name, that shouldn't cause any problem, as the N-400 asks for first, middle, and last names.

Hi Jackolantern,

No, she is a US citizen by birth, and she's never taken any legal action to change her name. A legal marriage then, does not count as "taking a legal action" so I am going to use the name that appears on her birth certificate.
